Chief Justice of India (CJI) DY Chandrachud delivered his final verdict in the Supreme Court on Sunday before he retires.

After him, Justice Sanjiv Khanna will take over as CJI as his successor. Chandrachud’s final judgment was against Bulldozer Justice.

Let us tell you that in recent times, this has become a system in which state governments and their departments resort to destroying people’s personal properties without proper legal process.

Action is taken against people whose names appear in any crime.

This decision was given on 6 November by the bench of the Supreme Court which was headed by CJI Chandrachud. In this Justice J.B. Pardiwala and Manoj Mishra were also included.

This case was related to the demolition of the ancestral house of journalist Manoj Tibrewal Akash in 2019. The Supreme Court found that only a public announcement for this was made through “Muhurat”. Neither was any written notice or legal basis clearly stated for this.

What was the matter?

In 2019, public announcement was made only through “Muhurat” (sound of drum). Nor was it explained through any written notice as to why this step was taken. The Supreme Court considered this process a violation of legal procedures.

The Supreme Court bench directed the state government to pay an interim compensation of Rs 25 lakh to the petitioner in this case. Also ordered to take disciplinary action against the officials responsible for illegal demolition.

In his judgment CJI Chandrachud termed bulldozer justice as completely unacceptable. He said, “Bulldozer justice is like turning the right to property (Section 300A) under the Constitution into a dead letter.

This is completely unacceptable.” He further said, “Justice through bulldozers is not acceptable in any civilized justice system.

If this is allowed, demolition of citizens’ property by any officer or department of the State may amount to unjustified retaliation.”

DY Chandrachud also remarked that the voice of citizens cannot be suppressed by destroying their houses and properties.

He said, “A man’s last security is his home. The law condemns illegal occupation and encroachment of public properties, but it protects the right to property.”

The Supreme Court bench also said, public responsibility should be the norm for officials.

“The officials who committed or approved such illegal actions should be taken to disciplinary action and should face criminal penalties for their violations of the law.”

Let us tell you that DY Chandrachud took charge as the Chief Justice of India on November 9, 2022. He gave many important judgments to protect judicial independence, civil rights and maintain the spirit of the Constitution.

His last order symbolizes that he has always been in favor of legal processes and protecting the rights of citizens.

CJI Chandrachud is retiring on Sunday i.e. 11 November 2024. Justice Sanjiv Khanna will take charge as the 51st Chief Justice of India on Monday.
