There was a heated argument between a petitioner and the bench in the Supreme Court on Tuesday, after which security was called and the petitioner was taken out of the court.
Petitioner Arun Ramchandra Hublikar had filed the petition against former Chief Justice Ranjan Gogoi. Gogoi is currently a member of Rajya Sabha.
In the petition, he alleged that his life has become difficult due to former CJI Gogoi’s interference in an order related to a service dispute.
However, a bench of Justices Bela M Trivedi and Satish Chandra Sharma expressed dissatisfaction with Hublikar’s arguments and refused to hear the petition.
When the judges advised the petitioner not to name the judge, he insisted that he be heard. After this the heat increased in the court.
Arun Ramchandra Hublikar filed a petition in the apex court against his “illegal dismissal” from the service and sought an internal inquiry against former Chief Justice Gogoi for rejecting the petition filed in the past in the service dispute.
Angered by the allegations, a bench of Justices Bela M Trivedi and Satish Chandra Sharma ordered the security personnel to escort Hublikar out of the courtroom.
A bench headed by Chief Justice DY Chandrachud had on September 30 taken strong objection to the petition seeking investigation against the former CJI and asked the petitioner to remove the judge’s name from the list of parties.
During the hearing on Tuesday, the bench got angry when the petitioner took the name of the former CJI. He said, “We are going to fine you. Do not take the name of any judge. There is no merit in your case.”
However, the petitioner objected and said, “How can you say that my case has no merit. How can this be said… This is injustice against me. At least I should get justice before I die.” On this the bench said that it rejects the petition, after which the security personnel were directed to take the petitioner out of the court room.
In order to list the petition for hearing, a bench headed by Justice Chandrachud had put a condition before the petitioner to remove the name of the former CJI from the list of parties.
The bench had said, “How can you file a petition making a judge a respondent? Some dignity should be maintained. You cannot just say that I want an internal inquiry against a judge. “Justice Ranjan Gogoi was a former judge of the Supreme Court.”
He had said, “Justice Gogoi retired as the Chief Justice of India. You cannot say that I want an internal inquiry against a judge because you have not been successful in getting your arguments across his bench. Sorry, we can’t tolerate this.”
After Hublikar assured that the name of the former CJI would be removed from the list of parties, Justice Chandrachud ordered the listing of the petition, which was heard on Tuesday. Justice Gogoi retired on 17 November 2019.
