The Supreme Court has strongly reprimanded the Central Government over the bulldozer action.
On Monday, the Supreme Court made it clear that even if a person is found guilty, the building will not be demolished.
A petition was filed in the apex court against ‘Bulldozer Justice’, in which it was said that as part of ‘revenge’ action, houses were being demolished without any ‘notice’.
The petition was filed by Mohammad Hussain of Madhya Pradesh and Rashid Khan of Rajasthan. A bench of Justice BR Gavai and Justice KV Vishwanathan was hearing it.
According to media reports, the court said, “How can a house be demolished just because someone is an accused? Even if he is guilty, it cannot be demolished….” The court will hear the matter further on next Monday.
On Monday, the court stressed that it does not support illegal constructions on roads or other public places, but the process of demolition of the property should be as per the law.
Solicitor General Tushar Mehta told the court that no property is demolished just because it is involved in a criminal case or is linked to a convict. He said that this happens only when the structure is illegal.
On this, Justice Gavai said, ‘So you are accepting it…. Then we will issue guidelines based on this. How can someone’s property be demolished just because he is an accused?’
