Kapil Sibal seems to be surrounded in the case of rape and murder of a trainee doctor in Kolkata.
Actually, Kapil Sibal had issued a resolution as the President of the Supreme Court Bar Association (SCBA). In this, he had described the rape incident that took place in Kolkata’s RG Kar Medical College as a big disease.
It is being said that this proposal of Kapil Sibal is normalizing the most heinous case of Kolkata. Regarding this, former President of Supreme Court Bar Association Adish Agarwal has written a letter to Kapil Sibal.
In this letter, he has asked Kapil Sibal to apologize. If he does not do so, he has warned of a no-confidence motion against him.
Agrawal has written in his letter that the proposal issued by Kapil Sibal was not approved by the Executive Committee of the Supreme Court Bar Association. Thus, this proposal is illegal.
Agrawal has also accused Sibal of misusing his position. He has written that in this manner he is downplaying the incident.
Apart from this, he was also accused of conflict of interest by representing the West Bengal government and making such statements.
He wrote in the letter that you are representing the West Bengal government in the Supreme Court. As a lawyer, you have full right to accept and argue cases.
On August 21, 2024, you issued an alleged resolution of the SCBA. It described the RG Kar Medical College incident as a disease. It also said that the resolution hopes that such incidents that have happened across the country will not be repeated.
In his letter, Aggarwal said such a statement is mischievous, dangerous, insensitive and a gross injustice to the rape-murder victim and lakhs of doctors, trainees and students.
These people are still protesting and demanding a safe working environment. The letter further states that Kapil Sibal should withdraw this proposal and apologize publicly within 72 hours.
If this is not done, a no-confidence motion will be brought against Sibal. Agrawal’s letter criticises Sibal for attempting to downplay the seriousness of the RG Kar Medical College case.
This case is being investigated by the CBI. It is worth noting that many members of the Supreme Court Bar Association had also expressed concern about this proposal.
