Prime Minister Narendra Modi has strongly advocated for Uniform Civil Code (UCC) in his address on the occasion of Independence Day.
He said that now the time has come for the country to move towards such a civil code which is secular and not communal and discriminatory like the existing civil code.
The All India Muslim Personal Law Board (AIMPLB) on Saturday expressed objection to PM Modi’s statement.
“The Board makes it clear in clear terms that this is unacceptable to Muslims as they will never compromise on Sharia law (Muslim Personal Law),” the Board said in the statement.
Board spokesperson SQR Ilyas said, “We are surprised at the Prime Minister’s announcement of declaring personal laws based on religion as communal and replacing them with a secular civil code.”
On Thursday, from the ramparts of the Red Fort, Prime Minister Modi had said, “I say that it is the need of the hour that there should be a secular civil code in the country.
We have spent 75 years under a communal civil code. Now we have to move towards a secular civil code. Only then will we be free from discrimination on the basis of religion in the country.”
Ilyas said that this is a well-planned conspiracy which will have serious consequences.
He said the government should uphold the remarks made by the chairman of the Law Commission appointed by the BJP government. He had clearly stated in 2018 that a Uniform Civil Code is neither necessary nor desirable.
Ilyas said the Board considers it important to mention that the Muslims of India have made it clear several times that their family laws are based on Sharia, from which no Muslim can deviate at any cost.
He said the country’s legislature itself has approved the Shariat Application Act, 1937 and the Constitution of India has declared the right to profess, propagate and practise religion as a fundamental right under Article 25.
He said the family laws of other communities are also based on their own religious and ancient traditions. “Tampering them and trying to make a secular law for all is basically a denial of religion and imitation of the West,” he said.
