At the same time, OP Rajbhar, a minister in the Yogi government, said that the decision of the Supreme Court is welcome. It is being welcomed throughout the country. The government’s aim has never been to demolish anyone’s house. At the same time, there is a lot of discussion going on regarding the guidelines of the Supreme Court. There is no restriction on bulldozer action in this. In such a situation, brakes will not be applied on Baba’s bulldozer.

What is the matter of bulldozer action?
Actually, the demolition drive to be held in Jahangirpuri, Delhi in April 2022 was carried out. Several petitions were filed in the Supreme Court regarding the Jahangirpuri incident, after which the campaign was banned. However, the petitioners demanded the Supreme Court to order that no officer can resort to bulldozer action as a punishment. In August, two petitions were filed in the court against bulldozing actions by authorities in Madhya Pradesh and Rajasthan. One of these was related to a case in Udaipur, where a man’s house was demolished because his tenant’s son was accused of a crime. In Uttar Pradesh too, the petitioner had approached the court regarding a similar case. He said that merely because a person is accused of being involved in a crime cannot be made a ground for demolition.

Supreme Court has given order
The Supreme Court had heard the petition filed on bulldozer action. In the decision given on Wednesday in this case, it was said that no one’s house can be destroyed. The Supreme Court has said in its order that it has kept in mind the rights given in the Constitution, which provide protection to the people from arbitrary action of the state. The Court clearly stated that the rule of law ensures that people know that their property cannot be taken away without just cause. The court said that if government officials take law into their hands and take such action, they should be made accountable. The court also said that we have considered the division of power. Have you understood how the executive and judiciary work in their respective areas? Judicial functions are entrusted to the Judiciary. The executive should not do this work in place of the judiciary. The court further said that if the executive demolishes a person’s house merely because he is an accused. This is a violation of the principle of separation of powers. The court has the right to punish a person after following the legal process.

The court has not stopped the action
The court has not completely banned the bulldozer action. The court has made it clear in its order that no property can be demolished unless its owner is given notice 15 days in advance. The court said that this notice will be sent to the owner through registered post. It will also be pasted on the outer wall of the construction. The notice will state the nature of illegal construction, details of the violation and reasons for demolition. The bulldozer action will also be videographed. If these guidelines are violated then it will be considered contempt of court. The Supreme Court said that for a common citizen, building his own house is the result of many years of hard work, dreams and aspirations. The house symbolizes security and a collective hope for the future. If it is taken away, officials will have to prove that taking the step was their only option.

Action has been happening continuously in UP
Bulldozer action has been happening continuously in UP. In fact, after CM Yogi Adityanath became the Chief Minister in 2017, bulldozer was made a model to control criminals. However, it came to light that action was already underway regarding all the bulldozer actions taken by the Yogi government. Even during the hearing on bulldozer action in the Supreme Court, Yogi government made its position clear. It was said that the action of departments like Development Authority in urban areas and PWD in rural areas is already underway.
