The Supreme Court granted bail to Bibhav Kumar, a close aide of Delhi Chief Minister Arvind Kejriwal.
He was accused of assaulting MP Swati Maliwal. During this time, the apex court has also made important comments about trolling on social media.
The court has told that it also faces online trolling and how it deals with it.
On Monday, a bench of Justice Suryakant and Justice Ujjal Bhuiyan was hearing the case. The court has granted bail to Kumar in the case of assault on Maliwal.
During the hearing, Maliwal’s lawyer told the court that the crime did not end with the assault and it is still continuing on social media.
He said, ‘The petitioners and their supporters are trolling me on X and everywhere.’ To this, Kumar’s lawyer Abhishek Manu Singhvi said, ‘Do I control social media? Your Lordship knows how we and judges are trolled.’ Justice Bhuiyan said, ‘Trolling is unfortunate. When we give a verdict in favour of one, we are also trolled by the other side.’
How does the judge handle it?
Justice Kant said, ‘There is a large class of irresponsible people who are not aware of their rights and duties.
They continue to attack, but you should ignore them. After this, their credibility is lost.’
what was the matter
While granting bail on Monday, the Supreme Court said that Bibhav Kumar has been in custody for more than 100 days. The bench also noted that the prosecution is going to examine more than 51 witnesses and the trial will take time to complete.
The bench also said that since the chargesheet has already been filed in the case, Kumar’s release will not have any adverse effect on the investigation.
Kumar had challenged the July 12 order of the Delhi High Court in which he was denied bail.
Bail granted with conditions
To address concerns about the possibility of Kumar influencing witnesses, the bench granted him bail with several conditions.
The bench directed that Kumar will not be reinstated as personal assistant to Kejriwal nor will he be given any official charge in the Chief Minister’s Office.
The court also barred Kumar from entering the chief minister’s residence until the questioning of all the witnesses was completed.
The Supreme Court said, ‘The bail will be subject to other conditions imposed by the trial court.’ Kumar had allegedly attacked Maliwal at Kejriwal’s official residence on May 13.
Delhi Police arrested Kumar on May 18.
