UCC will be applicable, but… why does BJP want to keep this community out; Questions are being raised…

During the election campaign in Jharkhand, Union Home Minister Amit Shah made a big announcement saying that if BJP comes to power in the state, Uniform Civil Code (UCC) will be implemented.

At the same time, he also drew a line in this promise. He said that tribal communities will be kept out of it. UCC is one of the main issues of BJP.

Amit Shah is not the first BJP leader who has talked about implementing UCC and keeping tribal communities out of it.

Uniform Civil Code has been the agenda of the right-wing party since the time of Jan Sangh. For the last few years, the issue of keeping tribals out of its scope was added separately.

Actually BJP was seen as a party of the upper castes. In such a situation, it was a big challenge to woo the vote bank of Dalits and tribals.

During a public meeting on Sunday, Amit Shah said that it is his duty to protect the heritage and identity of tribal communities.

In July 2023, late BJP leader Sushil Modi had also said that tribal groups of northeastern states should be kept out of the ambit of the Uniform Civil Code.

After this, Union Minister Kiren Rijiju said in Arunachal Pradesh, we should not talk about Uniform Civil Code in the tribal areas of Arunachal.

You should know that it will not be implemented in tribal areas. Secondly, whatever laws are made, they are made only for the welfare of the country.

BJP minister SP Baghel had also said that the government does not want to interfere in the culture and beliefs of the tribals.

He had also said that appeasement politics cannot stop the implementation of UCC. He said, BJP nominated a tribal woman for the post of President.

It has the highest number of tribal MLAs, MPs and Rajya Sabha members. When it comes to the North-East, the party respects the people there. The party does not want to interfere in the social structure there.

He said that in the Sixth Schedule of the Constitution, special provisions have been made for the tribal areas of Assam, Meghalaya, Tripura and Mizoram.

Unless the state government takes some steps, no decisions related to the social structure of these states will be taken. Regarding Article 371A, he had also said that no law is going to interfere in the matter of Naga community.

Earlier this year, Assam CM Himanta Biswa Sarma had said that after Uttarakhand and Gujarat, Assam will become the third state to implement UCC.

He had also made it clear that tribals would be kept out of its scope. Tribal people have also been left out in the UCC draft of Uttarakhand.

BJP is also being criticized for its decision to keep tribals out. Opponents say that all this is being done only to target Muslims.
