Chief Justice of India (CJI) DY Chandrachud retired from his post on 10 November.
He delivered his last order on ‘bulldozer justice’ before retiring from the top post of the Supreme Court.
He strongly reacted to the practice of state governments illegally demolishing properties.
At the same time, after Chandrachud’s retirement, the question is now being raised that how will his post-retirement life be. He himself has talked about this.
He said, when a person retires as Chief Justice or a judge, people always see him as a judge. He also said that such a person should accurately represent the responsibilities of the position held by him.
Chandrachud said, “When you leave your post as CJI or judge, people always see you as a judge or CJI. I recognize that I must be true to the office I performed. Whatever work I do after retirement, it should be a symbol of that truth.”
CJI Chandrachud also highlighted that retired judges are required to serve in various tribunals such as the National Green Tribunal (NGT), National Consumer Disputes Redressal Commission (NCDRC) and Telecom Disputes Resolution Tribunal (TDSAT).
He said that the cases presented in these tribunals are of utmost importance. Judges handling these cases must have the highest level of integrity and expertise. This is why former judges of the Supreme Court and High Courts are appointed to these roles.
Concern over the role of tribunals
Chandrachud said that if these tribunals do not have judges of the highest level then there will be a negative impact on the development and transformation of the country’s economy. He called this a serious concern and said that the operation of these tribunals is necessary to deal with the growing legal and economic complexities in the country.
He appealed to the media to reconsider its approach towards retired judges accepting these roles. “We need former judges on these posts so that the process is fair and credible,” he said.
Questions were not raised on the validity of Parliament’s decision
Chandrachud also clarified that these roles for retired judges have been established by Parliament. In such a situation, it is not necessary to question or criticize the judges. “Society always expects a particular standard from a judge or CJI and I consider myself inclined to adhere to the same standard,” he said.
