The Supreme Court has already refused to take bulldozer action on the houses of the accused.
Now the news is that the Supreme Court is soon preparing guidelines regarding bulldozer action, which will be applicable to all communities across the country.
A hearing regarding this was held in the court on Tuesday itself. The Apex Court says that property cannot be demolished merely because of crime.
The Supreme Court says that under the guidelines, there will be complete freedom to take action against those who encroach on government officials. Also, this can be done without any prior notice.
It is reported that Madhya Pradesh, Uttar Pradesh and Rajasthan have also accepted that involvement in crime cannot be the reason for this action.
The court had also said that the guidelines would ensure that encroachers would not benefit from the order. Also, it will not hinder the work of the officers taking action.
The court also said that it is necessary to remove the religious places present in the middle of the road and in public places, because the safety of the general public is paramount.
During the hearing held on Tuesday, SG Tushar Mehta had said that bulldozer action should not be done on the basis of crime. Also, its use should be only under municipal laws.
He said that the process of pasting notices at home should be ended and notices should be delivered through registered post.
He said that if any kind of restriction is imposed by the court, it can be misused by real estate builders and law breakers.
The court has made it clear that the process of demolishing a building should not be done just because a person is guilty or accused.
The court said that the authorities concerned will also have to explain why demolition of the building was the only solution and said that the person should also be given an opportunity to lodge a complaint at the appropriate place.
